【大紀元2012年05月21日訊】（大紀元記者董韻報導）已在今年4月2日由移民局公佈，預期將於6月1日生效的境內申請豁免的新政策（DHS Docket No. USCIS-2012-0003），允許和美國公民結婚的非法入境者在美國境內辦理豁免（免除三年/十年不准入境的處罰），獲得批准後，申請人可以馬上回到原居住地的美國領事館辦理返回美國的移民簽證，然後返回美國。對此，美國加州移民律師蔣百庚向大紀元表示，這一法規存在缺陷，要求申請人沒有驅逐令在身才有資格申請，這令很多華人自動失去資格。
據悉，過去很多和美國公民結婚的非法移民不能在美國境內調整身份辦綠卡，就是因為非法入境。如果想辦理豁免就一定要回到原居住國辦理，獲得批准後才能回到美國。但是在原居住國沒有保證一定能夠獲得批准。所以大多數非法移民雖然和美國公民結了婚，也不敢冒險，寧願在美國黑著身份苦等也不願出境申請豁免。新政策可以讓他們在美國辦好豁免，然後放心出境辦理返回手續。
雖然新豁免法案在處理非法移民方面上向前跨出了一大步，但蔣百庚律師表示，這個法規有很多問題，其中一條就是要求申請人沒有驅逐令在身才有資格。這樣一來就讓很多人自動失去資格。他說，這會影響到很多非法留在美國境內的華人。
他說，這無疑是一個重大缺陷。由於移民局給社會大眾六十天（4月2號到6月1號）的時間提出批評和意見，大眾應該抓住時機，只要人數夠多，移民局就會考慮修改規則。

Dear Chief Aigbe:
I am writing to you regarding above-referenced provisional waiver. This proposal is a great step towards the long overdue solution for millions of undocumented immigrants. The problem is it only applies to those who are not subject to a removal order. The rule, as it stands now, will deny millions of undocumented people of their only opportunity to fairly adjudicate their applications，it will end their dream of a united family that they have waited over a decade.
I am talking about millions of hard working people who have no criminal violations, pay taxes, and contribute to their communities. Because of the horror stories that happen in consulate offices around the world, these people are afraid of going back to their home country for visa processing. But the proposed rule kicked them back to square one and would subject them to the endless and hopeless wait.
Please revise the rule to make people, who are subject to a final order of removal, equally eligible for the provisional waiver. Thank you for your kind attention to this matter.
